1. Acceptance of Terms
By accessing or using YimmiT's services, website, or mobile applications (collectively, the "Services"), you agree to be bound by these Terms of Service and applicable laws and regulations of Peru. If you do not agree to these terms, please do not use our Services. We reserve the right to modify these terms at any time, and your continued use of the Services constitutes acceptance of any modifications.
2. Eligibility
You must be at least 18 years of age to use our Services. By using our Services, you represent and warrant that you meet this age requirement, have the legal capacity to enter into a binding agreement, and are not located in, under the control of, or a resident of any jurisdiction where our Services are restricted or prohibited.
3. Account Registration and Verification
To access certain features of our Services, you must create an account. You agree to provide accurate, current, and complete information, maintain and update such information as necessary, and safeguard your account credentials. You are responsible for all activities under your account and must notify us immediately of any unauthorized access. YimmiT applies customer identification, verification, and monitoring procedures in accordance with anti-money laundering and counter-terrorism financing obligations, including guidance from the Unidad de Inteligencia Financiera del Perú. You agree to provide additional information or documentation upon request. Failure to do so may result in restrictions or suspension of your account.
4. Description of Services
YimmiT provides a digital asset platform that enables users to deposit, hold, and transfer supported digital assets, access conversion functionalities between supported digital assets, and utilize platform features that may provide access to market-based returns or rewards. Certain features may include automated allocation or conversion mechanisms based on user-defined preferences. All services are subject to availability and may be modified at our discretion. YimmiT does not guarantee any returns, yield, or specific outcomes. Users retain full control over their digital assets and decisions.
5. Prohibited Activities
You agree not to: (a) use our Services for any illegal purpose or in violation of applicable laws; (b) attempt to gain unauthorized access to our systems or networks; (c) interfere with or disrupt the integrity or performance of our Services; (d) engage in market manipulation or fraudulent trading practices; (e) use our Services to launder money or finance terrorism; (f) circumvent identity verification, monitoring, or compliance controls; (g) create multiple accounts for abusive or deceptive purposes. YimmiT reserves the right to monitor activity and take appropriate action, including reporting suspicious transactions to competent authorities.
6. Custody and Security
YimmiT may provide custodial services for supported digital assets. You acknowledge and agree that digital assets may be held in pooled or segregated wallets, YimmiT implements security controls to protect assets but cannot guarantee absolute security, and you are responsible for maintaining the security of your account access. YimmiT maintains internal controls, access restrictions, and transaction monitoring to safeguard client assets.
7. Intellectual Property
All content, trademarks, logos, and intellectual property displayed on our Services are owned by YimmiT or its licensors. You may not copy, modify, distribute, sell, or lease any part of our Services without prior written permission.
8. Limitation of Liability
To the maximum extent permitted by law, YimmiT and its affiliates shall not be liable for losses resulting from digital asset price volatility, loss of funds due to user actions or unauthorized access, third-party service failures, or indirect, incidental, or consequential damages.
9. Termination
We may terminate or suspend your account and access to our Services at our discretion, including for breach of these Terms, failure to comply with verification or compliance requirements, or requests from legal or regulatory authorities. Upon termination, your right to use our Services will immediately cease.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Peru. Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Peru.
